BENTONVILLE – The attorney for a Rogers woman accused of killing her husband will use a mental disease or defect as defense against the crime.

76-year-old woman charged with capital murder

 — Prosecutors have filed a capital murder charge against a 76-year-old Rogers woman accused of killing her husband.

Myrtle Walter is accused in the October shooting death of Paul Walter. Prosecutor Van Stone says he will waive the death penalty. If convicted as charged, Myrtle Walter could be sentenced to life in prison without parole.

Myrtle Walter pleaded not guilty in a Monday hearing.

Defense attorney W.H. Taylor says Myrtle Walter suffers from anxiety and dementia. He also said Walter’s husband raped her, which will be part of her defense. A judge had ordered an evaluation at Washington Regional Hospital’s Generations program, but she was later released on a $250,000 bond to live with one of her two daughters.

Taylor says he won’t pursue a defense of mental disease or defect. (Source)
